The states believe that this law is unfair and even unconstitutional. They say it’s wrong to make a small group of energy producers pay so much money. They also argue that these companies helped New York in many ways, like keeping the lights on and fueling industries.

West Virginia’s Attorney General, JB McCuskey, is leading the group of states. He said, “If we allow New York to get away with this, it will only be a matter of time before other states follow suit – wrecking our nation’s power grid.”

The lawsuit mentions that New York wants to use the money for local projects, like building a new sewer system in New York City. The states think it’s not fair to make energy producers and consumers in other states pay for these projects.
